This agreement is made and executed this ______ day of ____________, 20____, by and between NML Investments, LLC - BobcatParking.com, hereinafter referred to as Lessor, and ________________________________________________, hereinafter referred to as the Vehicle Owner-Lessee.  1. Vehicle Owner-Lessee further acknowledges that the vehicle is covered by liability insurance pursuant to the requirements of the Ohio Revised Code. 2. Vehicle Owner-Lessee agrees that the Lessor shall not be responsible for any loss, theft, or damage to any articles left in said vehicle or to said vehicle, nor shall the Lessor be responsible for any loss, personal injury, or property damage arising out of an accident involving said vehicle while in, or being driven to and from Union Street Parking Facility, howsoever caused. 3. Only the vehicle registered on the parking agreement may be parked in the parking lot. 4. The parking of all vehicles is to be “BACK IN” parking only or parallel parking in the applicable space. 5. Vehicle Owner-Lessee agrees that the vehicle for which parking decal is being given on the Union Street Parking Facility premises shall be driven and handled at the risk of the Vehicle Owner-Lessee thereof and any person other than the Vehicle Owner-Lessee driving and vehicle shall and is hereby agrees to be the servant of the Vehicle Owner-Lessee. 6. No additional decal will be issued except in case of exchanging vehicles, and in all cases the original decal must be returned to the office before the issuance of a new decal.  A fee of $10.00 will be charged for a new decal. 7. Any vehicle found to be leaking oil, transmission fluid, or any other will be towed from the premises at owner’s expense. 8. Inoperable vehicles, boats, trailers, motor homes, or trucks other than pickups will not be permitted to be parked on the premises. 9. No vehicles will be permitted to be worked on while on the premises. 10. Motorcycles and motorbikes will only be permitted to park in the designed area. 11. DO NOT block any other vehicle at any time. 12. DO NOT block any driving lanes.  Make sure the vehicle is parking in an actual parking space. 13. Decals cannot be sold or transferred to another driver. 14. No refunds will be given for unused parking time. 15. Decals cannot be altered in any shape or form. 16. Speed limit is five (5) miles an hour is to be observed in the parking lot at all times. 17. No reckless driving on parking lot at any time. 18. Parking decal shall be placed on the rearview mirror facing outward toward the front of the vehicle and be visible at all times.  If not, vehicle will be towed from lot at owner’s expense. 19. Vehicle is subject to a $15.00 a day parking fee while vehicle is on the lot with any expired decal.  These charges must be paid before a new parking decal can be issued. 20. All parking tags remain the property of Union Street Parking Facility. 21. It is the responsibility of the Vehicle Owner-Lessee to come in and renew the parking tag prior to the expiration date.  Failure to do so will result in the vehicle being towed from lot at owner’s expense. 22. Vehicles left on the lot with an expired decal are subject to provision #18, #20 and/or will be towed form lot at owner’s expense. Also, will be subject to storage charges by the towing company. 23. Old parking decals must be returned to the office before issuance of a new tag. 24. DURING OU’S HALLOWEEN WEEKEND, ANY VEHICLE THAT LEAVES THE LOT WILL NOT BE QUARANTEED A SPACE IF THEY LEAVE THE LOT AND THEN TRY TO REENTER THAT FRIDAY, SATURDAY, OR SUNDAY.  ANY VEHICLE THAT LEAVES WILL BE CHARGED TO REENTER THE LOT, IF SPACE IS AVAILABLE. 25. The only area that the Vehicle Owner-Lessee is allowed to park in is the third section of the parking lot from the street all the way back to the Ohio Lottery building and to the side of the Ohio Lottery by the hillside.  The small section in front of the OU offices, and the center section of the lot are owned by Ohio University.  No parking is permitted in these two (2) sections.  If your vehicle is parking in either of these two (2) sections, the vehicle is subject to a parking ticket and towed.   Vehicle Owner-Lessee agrees to pay the Lessor, its successors and assigns, during said term of this lease the daily, weekly, monthly, semester, or academic year sum of $__________________ in advance.  There will be a $40.00 charge for any return checks.  The failure of the Lessor to enforce this provision in any given period shall not constitute a waiver or any remedy by Lessor, or to collect at a later date.  Expiration date of tag is __________________________.  Tag is not valid after this date.    Union Street Parking Facility Contract – Page 2  Vehicle Owner-Lessee has read and understands this Agreement and the Parking/Driving rules enumerated above, and agrees that violation of this Agreement or any of the enumerated rules above, failure to pay in a timely manner when due, and the breach of any other rule covenant shall result in the towing of the vehicle at Vehicle Owner-Lessee’s expense and termination of parking privileges at the BobcatParking.com - Union Street Parking Facility.  IT IS FURTHER UNDERSTOOD AND AGREED, that in the event the agreement is terminated or revoked, Vehicle Owner-Lessee agrees to move vehicle from the Union Street Parking Facility premises with twenty-four (24) hours of notice of such termination or revocation, or said vehicle will be towed at owner’s expense.   ___________________________________________________/_____________________________________________________ Signature of Vehicle Owner-Lessee (Print Name)    _________________________________________________ Vehicle Owner-Lessee’s Phone Number in Athens or cell    _________________________________________________ Lessor – BobcatParking.com - NML Investments, LLC - Bobcat Parking - Union Street Parking Facility    Please fill out the information in bold letters.  The decal number and decal expiration date will be filled out by the person issuing the parking tag.  Year of Vehicle Make and Mode of Vehicle Color of Vehicle Vehicle License Plate Number Issued State of License Plate Parking Tag Decal Number Decal Expiration Date Home Address   Athens Address
